Shooting death in a Pennsylvania pizza shop

(Levittown)_A suburban Philadelphia prosecutor says no charges will be filed against a customer who fatally shot one robber and critically injured another during a holdup at a pizza shop.

District Attorney Matthew Weintraub announced his finding in the shooting on Tuesday night at Porfirio's Pizza and Pasta in Levittown, about 25 miles northeast of Philadelphia.

Police say the customer and two pizza shop employees were the only people in the restaurant when the two armed suspects walked in.

Weintraub identified the deceased suspect as 24-year-old Shawn Rose.

His 22-year-old brother is in critical condition at Thomas Jefferson University Hospital.

Authorities say the customer took out a gun and shot both men after they pistol-whipped him.

Police say the customer's gun was properly registered, but they're unsure if he had a concealed carry permit.
