Judge mulls pulling ballot question from next week's primary

(Harrisburg) -- A Pennsylvania judge is considering whether state and county elections officials should pull a constitutional amendment question on judicial retirement age from the ballot for next week's primary election.

Commonwealth Court Judge Kevin Brobson did not say when he would rule following a four-hour hearing Tuesday on a lawsuit by three Democrats in the state Senate.

The senators are challenging a resolution that passed both legislative chambers earlier this month postponing the vote until November, rewriting its wording and telling election officials not to tally any primary votes on the ballot question.

Elections officials say they don't have time to test computer changes and worry that tinkering with the system could make it harder to produce accurate election-night results in the high-profile election.
