(York) -- A York County judge says he doesn't think a defense being considered for three prison guards accused of mistreating inmates will hold up at trial.
Twenty-eight-year-old David Whitcomb, 26-year-old Mark Haynes, and 37-year-old Daniel Graff are charged with official oppression and harassment.
Prosecutors allege they forced inmates to do such things as eating a spoonful of cinnamon or taking pepper spray to the face in exchange for food and other privileges.
The York Daily Record reports defense attorneys have discussed the idea of using consent as a defense, arguing that inmates weren't forced to do anything. But prosecutors said inmates rely on guards for safety, food and housing.
Judge Richard Renn says he didn't think the issue would figure in the case.
