(Reading) -- A mistrial has been declared in the weapons case involving a Berks County man whose son killed a sheriff's deputy.

Seventy-two-year-old Maurice Connor of Albany Township, Berks County, is accused of giving a handgun and $200 for a rifle to his son Matthew Connor, a convicted felon who was not allowed to possess firearms.

Matthew Connor then shot and killed Deputy Sheriff Kyle Pagerly in June 2011, before dying in the exchange of gunfire as authorities tried to arrest him at his home on burglary and weapons offenses.

The judge declared the mistrial Wednesday after learning that five members of the jury figured out that the charges against Maurice Connor were connected to Pagerly's death.

A new trial date has not yet been scheduled
