(State College) -- A spokesman for Penn State University's board says student trustee Peter Khoury had to make a choice between being plaintiff in a lawsuit against the NCAA or staying on the search committee that's looking for a new university president.

Board spokesman David LaTorre says all five trustees who joined in the suit filed by the family of the late football coach Joe Paterno have conflicts of interest because the suit makes allegations at odds with the university's position.

LaTorre said Khoury's conflict would have prevented him from carrying out his role on the presidential search committee because he would have to recuse himself from much of the discussion.

Koury has said he plans to withdraw from the lawsuit that seeks to overturn the NCAA sanctions against Penn State.
